Dakine will not be joining us on the exiled. Ever.

I shall start from the beginning. Dakine requested me to use MY credit through Dell Financial to get enough money to buy a brand-new $2065.50 computer, and give it to him under a verbal agreement that he would pay $180.00 per month. At the $180 per month rate, the computer would be paid off in under a year, thus avoiding any interest on the purchase whatsoever. The purchase date was June 7, 2008. In the six payments made before things got ugly, he missed two altogether and under paid on three. This was a violation of the agreement, but I let him slide. He's my friend, right?

Well, in November he lost his job due to clocking in and going home. They finally caught him, realizing that over the whole time of his employment he had missed about a month of work but was still getting paid. Needless to say, they canned his ass. So, after losing his job, I decided that I better get the fuck out of that apartment before he quit paying me for the rest of the services I provided for him, including: phone, cell phone, internet, and computer. I moved out in early December.

On Monday of this week, he invited a mutual friend to dinner, and offered to pay for his meal. I overheard this. I also learned that he had purchased Christmas presents for several people, and a digital camera for himself. All this he did while still owing a balance of $930.00 to me, his friend. *side note: he got $3,400 after being fired. It was payment for vacation leave and he pulled his retirement. I asked him at this point to please pay up, he refused.*

I go to the restaurant with the mutual friend, who is KBKiller, and eat. We're done, and I ask him to pay for my meal (17.99) and he refuses, citing he can't afford it.

ME: "So you can buy x-mas presents for everybody but me, a digital camera for yourself, and food for friends, but you cant pay back the guy who loaned you $2,000?"
HIM: "Fuck you."
ME: ::insert terrible and embarrassing tirade of name-calling::

He then gets up and walks out, paying for his and KBKiller's tab. 30 minutes later, I get a call from his big brother (my ex-landlord) and he starts in on me with name-calling. *side note: who runs home to their brother?? PUSSY* I name-call back, his g/f gets on the phone and starts in, and my clever brain goes into overdrive, making her screaming mad to the point the big brother had to wrestle the phone back. He said we would talk about it the next day.

The next day comes. The big brother and I discuss everything like men, and I even agree to no longer seek the return of Dakine's computer, but will accept continued monthly payments at a reduced rate. In other words, both parties got off the phone satisfied and without any ugliness.

The next day comes. I get a text message from big brother's g/f. Apparently, he turned over his pants and balls, and she's runnin' the show now. I call my local Sheriff's department and speak to a detective. I provide proof of ownership not only on the computer, but a few other items I had there. She, the detective, calls them and informs them that I have a good case and will certainly press Grand Larceny charges against them. The same day, they agree to drop everything off.

I get a call from the detective that same day at 4:25pm eastern time. She, laughing, informs me they dropped my stuff off with 5 minutes left to go before the Sheriff's office closes. I laugh too, and tell her that these people are common to the last drop. Kinda like Folger's, but worse.

The next day comes (today). I go to the Sheriff's office and get my stuff. However, one item is missing. My leather car case for carrying music CD's. To be precise, $768.80 worth of music CD's. I guess the threat of being charged with Grand Larceny isn't good enough for the big brother to return all my stuff. *side note: he returned a few items that were mine that I had NO proof were mine, but kept the CD's, which I have Amazon.com record for, and bank records for.*

I spoke with my detective again this afternoon, and will be actually pressing charges next Monday. If convicted in the criminal court, he will have spent a lot of money on lawyer fees, then pay a $2,500 fine, then serve a mandatory minimum of one year in prison. A side effect of all this will be his loss of his cushy government job, during our current economic times.

MY CASE: I have not only the CD cases, but a complete listing of all of them, when they were bought, who bought them, and where they were shipped. All of that is from Amazon.com. To correspond with that information, I have matching bank and credit card records. On top of that, I had a tape recorder running when I confronted them before this began, and have them confirming possession of the CD's and confirming that they refused to give them to me. On top of all this, I have a mutual friend who will testify to the fact that he saw them (the CD's) at my former residence in the possession of the big brother and that I did not have them at time of moving out.

CONCLUSION: You DON'T fuck with SIR GRIFFIN. Dakine is a deadbeat piece of human waste, and I strongly doubt he will make a showing online anytime soon, especially since he has no job nor computer. Muahahahahaha!!

All honestly Griff, is it realy worth sending an ex-friend to jail and fucking over his life... over some CD's? I mean I dont know either of you personally, nore do I know the entire story... but I dont like people and friends tearing each other apart.

I mean what if he spirals down hill even more and god forbid off's himself or something stupid and crazy... I wouldn't want to see you have that in the back of your head. I know it is far fetched, but people are crazy and life is too short to fuck with.

But what ever you do, its your deal... I am just throwing my friendly 2 cents in.

Krazy, if he killed himself, I would laugh myself to sleep. You see, I have some kinda psychological disconnection. I hated this black kid in school for always picking on me. One day, in Junior year, years after the incidents, he died in a car accident. I honestly laughed, a good hearty laugh and was happy. When I thought of his family's grief, I smiled wider.

Sorry Griff sounds like a real sucky situation. My only 2 cents would be to let go of the hate (sooner rather than later) - just because he's a dick doesn't mean he's got to drag you and your mood down. Sounds like its time to move on! bounce

UPDATE: The big brother came to my work, unexpectedly, and returned all of my property; including the CD's. I promptly called the Sheriff's office, informed my detective of what happened, then had the matter dropped.

However, now Deadbeat Dakine has sued me for $1,160.50 + $59 court costs for what money he did pay me for the computer.

Okay, I can understand that. Despite the fact that if he tells the truth, and shows the judge his bank-made copies of his checks to me, then the judge will see where he missed two payments and underpaid six times. If the truth about our verbal agreement is said by the both of us, the judge will see where he already violated the agreement but that I obviously and so kindly let it slide. I explain to him that after Dakine lost his job and I moved out and things got ugly, that I had no choice but to take my collateral and make good on the verbal agreement.

VERBAL AGREEMENT: Dakine pays Sir Griffin $180 per month for twelve months. If payment fails to be made, Dakine loses ownership of computer and all money spent on it to that point.

SIDE NOTE: If he was going to sue me for the computer, then why did he wipe it first, restoring only the OS? Did he not know he was deleting software that isn't on the recovery disks? I still need to price it, but what a silly move. Should have left it the fuck as is.

So, after the verbal agreement is stated, he sees the proof of payment and thus proof of violation of verbal agreement. Then I speak about the loss of software, and that the computer was not returned to me in the condition it was loaned to Dakine.

BEST CASE SCENARIO: Judge rules for me, agrees Dakine didn't hold up to his end of the bargain. I laugh.

WORST CASE SCENARIO: Judge rules for Dakine. At the least the Judge will make Dakine pay some kind of rental fee, reducing the amount I have to pay him. I plot.

Either way, he will learn a valuable lesson that will be with him for the rest of his life.

So due to the haunting memory of that useless tard, and some more responsibility at work, I have been on a little less lately than I would like. Oh yeah, and my hard drive died a horrid loud death yesterday afternoon. Western Digital was it's make. Lasted 2 years 3 months. Bought a 500GB Seagate. Lost all my data again for the third goddamn time. I need to buy an external hard drive. Any suggestions?

It's over guys. Pussy Dakine didn't even show for his court date. Thus, the judge dismissed the case, with prejudice, so there shall be no re-filing.

I get to keep the $2065.50 machine, while only having to pay $900.00. Thank you Dakine, you fucking idiot.
